TakeOff‘s November 2022 murder was a traumatic event for his friends and family, and more than 18 months later people are still battling in court over who is responsible.
The late rapper’s mother Titania Davenport filed a $1 million lawsuit against the owners of the venue where he was killed back in June of last year, but now the owners are pushing back.
According to Radar Online, the owners of the Houston, Texas establishment, 810 Billiards and Bowling, have asked to be dismissed from the lawsuit.
Back in January, another one of the defendants, Midway Companies, LLC, blamed TakeOff in part for the tragedy. In a court filing, they put responsibility for the shooting, partially, on “Decedent Kirsnick Khari Tiquon Ball [TakeOff] failing to exercise ordinary care for his own safety.”
Now, the 810 Billiards owners have followed suit. They said in a filing: “There is a reasonable probability that the occurrence in question as well as the damages complained of were proximately caused, in whole or in part, by unknown criminals who participated in unlawful gambling and/or the illegal possession of firearms.”
“Defendant is not liable to Plaintiffs because Plaintiff’s own acts or omissions proximately caused or contributed to Plaintiff’s injuries,” they continued.
The Migos rapper was gunned down at 810 Billiards and Bowling in downtown Houston in the early hours of November 1, 2022. He was 28 years old.
TakeOff and his uncle/groupmate Quavo were partaking in a dice game when an altercation broke out and shots were fired, striking TakeOff “either in the head or near to his head.” Despite initial rumors suggesting he was also shot, Quavo was not injured.
On the criminal side, two men, Patrick Xavier Clark and Cameron Joshua, have been arrested and charged in the case.
Joshua was arrested in Houston on November 22, 2022 and charged with felony unlawful carry of a weapon. The 16-year-old rapper, who goes by the name Lil Cam and is allegedly affiliated with J. Prince Jr.’s Mob Ties Records, is believed to have been in attendance at the private party where TakeOff was murdered.
Prosecutors claimed surveillance footage showed Joshua brandishing a weapon at the scene of the crime, but the district attorney’s office didn’t go so far as to accuse him of shooting TakeOff.
Clark was officially indicted on murder charges on May 25, 2023 by a grand jury.
